Practice 03

Wills, powers of attorney and estates.

Two meetings and a signing for most families. Flat-fee packages, written in language your executor will understand.

Own a company? Your will and your shareholder agreement should say the same thing about your shares. We check both.

Packages

Every package includes all three documents.

A will deals with your estate after death. An enduring power of attorney covers money and property if you can’t manage them. A health care directive says who decides about your care, and what you want.

Manitoba stopped charging probate fees in 2020. The “two wills” plan often used in Ontario to cut those fees rarely helps here, so we don’t sell it.

Making a will

How it goes.

Hands sorting printed forms beside a calculator and a pen on a white table
  1. Before we meet

    A short questionnaire

Family, what you own, and who you trust. Fifteen minutes; rough numbers are fine.

  2. Meeting 1 · 60 min

    Decisions

Executor, guardians, who gets what, and when. We point out what people commonly forget, like RRSP and insurance beneficiaries.

  3. Within 10 working days

    Drafts and a summary

Your documents, with a one-page summary in plain English. Change anything you like.

  4. Meeting 2 · 30 min

    Signing

Two witnesses from our office. We keep the originals safe and give you signed copies.

When someone has died

Administering an estate, month by month.

Executors carry the legal duty and do a lot of the legwork. We tell you what to do next, handle the court and the paperwork, and keep beneficiaries informed.

A typical estate over about 16 months: apply for the grant of probate in months 0 to 3, advertise for creditors in months 2 to 4, collect assets and pay debts in months 1 to 8, file final tax returns in months 3 to 9, wait for the Canada Revenue Agency clearance certificate in months 8 to 14, then account to beneficiaries and distribute in months 12 to 16. 0MONTH 481216 Grant of probateCourt of King’s Bench Notice to creditors Collect assets, pay debts Final tax returnswith the estate’s accountant CRA clearance certificate Account and distribute

Contested estates

If someone is challenging the will or the executor, that is litigation, and we refer it to a firm that does it. We can still help the executor with everything else in the meantime.
